Terms of Service
1. What ClaimWisely is
ClaimWisely ("ClaimWisely", "we", "us") is an administrative membership service that helps members identify publicly administered class-action settlement programs they may be eligible for, and prepares and submits claim forms and supporting information to the independent, court-appointed settlement administrators that run those programs.
ClaimWisely is not a law firm, does not provide legal advice, legal representation or advocacy, and no attorney-client relationship is created. Nothing on our website, in our emails or in your membership is legal advice. We do not file lawsuits, negotiate settlements, or appear in court on anyone's behalf.
2. No guarantee of recovery
Eligibility, claim approval, payout amounts and payout timing are decided solely by each settlement administrator and the overseeing court — never by ClaimWisely. Figures shown on our website (including annual or per-case amounts) are industry statistics or illustrative scenarios, not estimates, quotes or guarantees of what you will receive. We do not promise that any member will receive any specific amount, or any payment at all.
3. Your account and your obligations
- You must be at least 18 years old and a U.S. resident to use the service.
- You agree to provide information that is true, complete and accurate to the best of your knowledge. Claim forms are frequently signed under penalty of perjury; submitting a false or fraudulent claim is your sole responsibility and may carry legal consequences.
- You must tell us promptly if information changes, and you must tell us about claims you have already filed yourself so duplicates are avoided.
- You are responsible for keeping your login credentials secure.
4. Limited authorization
By subscribing, you grant ClaimWisely the limited authorization described in our Authorization to File to prepare and submit settlement claims on your behalf. That authorization can be revoked at any time in writing.
5. Subscription billing
Membership costs $9.99 USD per month, billed automatically on a recurring basis through PayPal until you cancel. You authorize this recurring charge at signup. We may change the price on at least 30 days' written notice; continued membership after the change constitutes acceptance.
6. Cancellation and refunds
You may cancel at any time through your PayPal account or by contacting us; there is no cancellation fee and no long-term contract. Your access continues through the end of the paid period, and claims already submitted continue to be tracked. Except where required by law, monthly fees are non-refundable; if we identify no settlement you are eligible for during your first 30 days, contact support@claimwisely.org for a review.
7. Payments to you never pass through us
Settlement awards are paid by the administrator directly to you (by check, prepaid card or digital payment). ClaimWisely never receives, holds, endorses or deducts from your payouts, and charges no commission or contingency fee.
8. Acceptable use
You may not submit false information, file claims for people without their authorization, create duplicate accounts, or use the service to violate any law, court order or settlement terms. We may suspend or terminate accounts that breach this section.
9. Third-party services
Checkout is processed by PayPal under its own terms and privacy policy; we never see or store your card or bank numbers. Settlement administrators are independent third parties with their own requirements.
10. Disclaimers and limitation of liability
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, ClaimWisely's total liability for any claim relating to the service is limited to the membership fees you paid in the three months before the claim arose. We are not liable for decisions made by administrators or courts, delayed or reduced payouts, or losses caused by inaccurate information you provide.
11. Changes to these terms
We may update these terms; material changes will be posted on this page with a revised date. Continued use after changes constitutes acceptance.
12. Governing law and contact
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Questions: support@claimwisely.org · claimwisely.org. See also our Privacy Policy.
